The protection of personal data is an integral part of the development of every product and function in it. Since successful relationships require mutual trust and mutual understanding, we aim for absolute transparency when processing your personal data.  When does this privacy information apply?

HuePress is not only a smart light bulb, but also a smart lighting ecosystem. The myHue smart light system consists of different parts and functions, requiring different ways of processing personal data.

This privacy notice applies to the HuePress system. Examples include:

  • when you visit or use our websites, apps or social media channels;
  • when you create an account with us;
  • when you purchase products directly from the HuePress online store;
  • when you use HuePress products, product functions, or applications;
  • when you sign up for newsletters, promotions, or other marketing initiatives;
  • when you contact or interact with our consumer care department; or
  • when you, in some way, interact with us or our system.

If you are not within the scope of this HuePress Privacy Notice, your personal data will fall within the scope of other privacy notices. When additional privacy terms or notices apply, we expect you to read them. You can check our privacy notices on huepress.vn website.

What information do we collect?

Depending on how you interact with us (e.g., online, in person, over the phone, etc.) and the type of products you buy, or how you use them, we will process different types of data about you.

Some data processing operations are essential requirements for our products to perform as expected or so that we can provide you with certain product functions. If you choose not to share this data, we will not be able to provide you with the complete functionality of the products, systems or applications. For example, if you choose not to grant our app location access on your phone, then our app won’t be able to tell when you’ll be home, or can’t tell the time zone or outdoor lighting conditions at a specific time of day. Therefore, contextual lighting schedules, automatic lighting schedules that follow the circadian rhythm, or the home and home schedules that you’ve set up won’t work because this schedule works thanks to your location information that the app receives.

We also process your personal data if you voluntarily share it with us. This type of data will help you have a more personalized experience. For example, the name you give to your myHue products.

Here’s an overview of the types of regular data we collect based on your use of our products, systems, or apps:

When you purchase products directly from us, we may collect the following personal data:

·       Order information such as contact information, invoice address and delivery; invoice history.

·       Information about the product you have purchased.

·       Payment status (about whether the payment was successful or not).

·       Delivery information and return information, if any.

Consumer care dataWe use personal data to provide you with consumer support services, answer your questions, fulfill your requirements, and provide you with corresponding consumer service. We may also use this personal data to improve, adjust our products and product functionality, as well as to train consumer care workers.

 

When you contact consumer support or when contacting one of our consumer care representative staff via email, phone, social media channels or similar, we will process the following Personal Data:

·       call record if you have received your approval, as needed.

·       the questions or requests you mentioned.

·       the status of that request.

·       any data sources we obtain if it is the information necessary to provide to consumer support.

Usage data related to our products and product functionalityWe use this data to provide the functions required, where appropriate, we will use to improve or develop new products and technologies through analytics, for the purpose of personalizing product functionality as well as for marketing activities.·      Device information,

·       log information,

·       location information – to the extent that this is essential information so that we can meet the requirements to use your services. For example, this is a requirement necessary for the myHue app to be able to activate the lights according to the specific schedule that you have set, such as activating at dawn and sunset time at your place of residence or when you go home or leave. Location data provided by your device through these services will be in your device. For myHue apps  or Devices that use Bluetooth, location data will be provided by your operating system as this is a condition for enabling a Bluetooth connection to  your (Bluetooth)  lamp. Your location data will not be shared with us.

·       other information about your use of our products, other information about your settings.

Online feedback dataWe use this personal data to help other users understand the value of our proposal.

 

When you use this function, we will process the following personal data:

·       Your comments and reviews;

·       Your identity (if any).

Data of online sweepstakes and contestsWe use this personal data to allow you to register for the contest, avoid fraud, make awarding prizes, and for media marketing purposes once you have your approval.If you decide to participate in our competition, it is up to you of your choice that we collect the following personal data:

·       Name, email address, phone number, postal address, date of birth, other information necessary or required under the terms of the contest.

Data collected from social platformsWe use this personal data to get an overview of how people feel about us and our brand, and to resolve product-related issues and product functionality.

 

User-generated contentIf you have consented, we may use the content you post online (for example, an image or video containing a HuePress product that you take) for public display on any of our channels.
User interactionIf you modify your account settings, username, or marketing permission status, our backend will log these events.
Contact formIf you submit a contact form or subscribe to our newsletter or marketing program, we process certain specific personal data about you.
Third party dataIn addition to websites, applications and other digital channels, we may collect information about you through a variety of other sources, e.g. social media platforms, co-marketing partners marketing or product functionality and product providers generally supporting the HuePress ecosystem, such as voice assistant vendors.

For example, if you control a HuePress product with a voice-enabled product (such as Amazon Alexa, Apple Siri, Google Assistant), you will be asked to allow that device to connect to the HuePress system. After enabling this functionality, we may collect and process functional data (such as registration data, usage and diagnostic information) and your usage accordingly. We do not receive or process audio.

How we use your data?

As described above, we may collect your data from a variety of sources. Below you will find an overview of our general purposes for using your data:

We do not sell or lease your personal data. We only share your personal data when required by law, if you allow it or to other parties on our behalf.

  • Public authorities and governments: if required by law or when it is necessary to protect our rights, we may share your data with organizations that control or have jurisdiction over HuePress or its subsidiaries.
  • Professional consultants and others: we may share your data with other parties including professional consultants, such as banks, insurance companies, auditors, lawyers, accountants, other professional consultants.
  • Other parties involved in the company’s transactions: sometimes, we may also share your data during the company’s transaction process as during the sale (part) of the business to another company or any reshuffle, merger, joint venture, or the transfer of a business, property or other stock (including in connection with bankruptcy or any similar activity).
  • For the parties in the internal ecosystem of HuePress
  • Comply with your privacy requirements if there is a requirement for the ability to move personal data.

Is your data shared abroad?

Currently, HuePress focuses on Vietnamese or foreign customers in the territory of Vietnam, and all huepress services are concentrated in the territory of Vietnam, so we have no plans to transfer data abroad.

It should be understood that third-party services, including Google or Amazon Web Service, can place servers overseas. Therefore, in this case, these third parties will be responsible for the data.

As HuePress’s services are global, data transfers can be done just to serve the interests and customer experience.

How long is your data stored?

We will store your data for as long as it takes to fulfill the purposes set out when collecting it (for detailed information about these purposes, see “How do we use your data?” above). Please note that in certain circumstances, the longer retention period depends on the requirements or permission of the law. The criteria used to determine the retention period include:

  • How long does it take to keep data to provide product or product functionality to you or to run our business?
  • Do you have an account with us? In this case, we will keep the data when your account is active or for the time necessary to provide product functionality to you.
  • Do we have to keep your data in order to comply with our legal obligations, contracts, or similar obligations? For example, data retention laws are required in applicable legal jurisdiction, government orders requiring the retention of data related to an investigation, or data that must be kept for litigation purposes, protection against possible claims or for tax purposes.

Data that has been processed to further improve your experience with us will be kept for the shortest possible time. We will then anonymize or delete that data if there is no longer a need to store the data for consumer, legal or business purposes.

We focus on data security when designing our systems, using appropriate technical and organizational measures. Privacy right from within design and privacy by default are the guiding factors in our design.

 

What is the legal basis for us to use your data?

  • Approve. If we use your consent as a legal basis for processing your data, you reserve the right to withdraw your consent at any time.
  • Contractual relationship. The need to establish a contractual relationship with you, to fulfill our contractual obligations and meet your requirements.
  • Legal obligations. The need for us to comply with our legal obligations and to establish, enforce or protect us from legal claims.
  • Legal rights. The need to pursue our legitimate rights, including:
    • to ensure our network and information are secure;
    • to manage and conduct joint business activities in HuePress;
    • to prevent or investigate violations of the law or suspected violations of the law, violations of corporate client contracts, or failure to comply with huepress’s code of integrity or other HuePress policies;
    • to optimize or expand our reach and increase relevance in our communication activities.
  • Protect the essential interests of anyone.
  • Any other legal basis that local law allows.

Is children’s data collected?

Our websites and mobile apps are designed for adults. We do not knowingly collect information from children under the age of 16.

What is your responsibility? We encourage you to take control of your personal data and find out what options are available. For answers to questions related to this notice, as well as other questions related to your personal data or privacy, please contact us.

Your responsibility?

We would like to note that, with all your knowledge, it is your responsibility to ensure that the data you provide to us is accurate, complete and up-to-date. Furthermore, if you share with us other people’s data, it is your responsibility to collect such data in accordance with local legal requirements. For example, you should notify those people, with whom you provide their data to us, the contents of this Notice, and receive their prior approval.

If you decide to sell or share our products with others, please note that certain such products may locally store personal data relating to you or the use of your products. In such cases, if you intend to share, return, or sell the device, please make sure that:

  • If you grant access to your HuePress account to third parties, you are still comfortable with these third parties being able to access the personal information contained in our products;
  • If you want to return or sell your device, remember to perform a factory reset for the product in question. Find instructions on how to restore this factory installation in the product manual or on our website; and
  • In any case, if you provide us with the personal data of any other individual during your use, you must obtain the consent of that individual before providing the information to us.

Your choice?

We look forward to giving you access to your data. Typically, you can control your own data (for example, by logging into your account), then update, modify, or, in some cases, delete the data. In this case, we strongly encourage you to control your data. You can exercise certain rights related to your data that we are processing. Specifically, you have the right to:

Withdraw your approval at any time. You have the right to withdraw your consent even if you have previously approved for us to process your data.

Opposed to the handling. You reserve the right to object to the processing of your data if the processing is carried out on a legal basis other than what you have approved.
Access to your data. You have the right to find out if we are processing your data, to disclose information about certain aspects of the processing, and to receive copies of the data being processed.
Verify and edit. You have the right to verify the accuracy of the data and request that it be updated or edited.
Processing restrictions. In some specific cases, you have the right to restrict the processing of your data. In this case, we will only process your data for storage.

If technical conditions permit, you have the right to transmit the data to another control unit without any hindrance. This provision may apply as long as your data is processed by automated means and the processing is obtained by your consent, in accordance with the contract you have signed or in accordance with pre-contractual obligations.

Please note that email communications are not always secure. Therefore, please do not include sensitive information in emails when sending them to us.

We will do our best to process your request promptly and free of charge, unless it requires disproportionate effort. Under certain circumstances, we may ask you to verify your identity before complying with the request. If you are not satisfied with the response received, you can forward your complaint to the relevant regulatory body in your jurisdiction.

Who are we?

HuePress is a global lighting manufacturing company, with 10 years of intensive R&D experience in lighting and light digitization, LiFi.  We also produce many devices in the HuePress ecosystem for smart home and smart city.

When this Notice refers to “we” means referring to the Data Controller as in this Notice, namely the huepress affiliate with which you have been, or will have a relationship or will have a relationship or decide which data to allow them to collect and how your data is used,  HuePress.
